PESHAWAR: Land surveys will be conducted in all districts of the province following the enactment of the Khyber Pakhtunkhwa Land Use and Construction Bill, 2021, to formulate land use plans throughout the province. Province.

The bill provides for the determination of existing planned and unplanned areas in the investigation under Article 15 (2).

Under Article 15 (3), depending on the results of the survey, the area will be classified in one or more of 13 land use classes, including residential, commercial, industrial, forestry, national park, mining, agricultural, public sector concentration area, recreation, mixed land use, barren and vacant land, water bodies, areas prone to natural hazards and other types of land use.

The land use plans that will be formulated in the light of the studies will include a description of the boundaries of the district and the tehsils as well as a complete topographic mapping of the area, using geographic information systems. The plans will also include coverage of water, sanitation and waste disposal services; identification of tourist and archaeological sites, descriptions and measurements of open and green spaces and traffic flows.

Article 21 of the bill provides for a land use authorization, when after notification of a land use plan or district master plan, no person, including a government agency, should use land or building for authorized purposes without the appropriate land use authorization.

In the event of a development authorization required for development, Article 22 provides that in the event of notification of a land use plan or master plan, no person or government body shall undertake to development of land, redevelopment of roads or construction of buildings without a temporary development permit issued by the planner. control agent.

Article 31 of the bill empowers the authority to propose an improvement in urban design. “When the urban design of an area has been classified as bad or when the government orders it, the authority itself or on instructions, the unit must formulate a proposal for improvement,” one reads.

According to the bill, such an improvement must contain a land use change plan, a redevelopment plan, a building stock renewal plan, any changes that may be required in development and ownership and measures that must be taken for a smooth and orderly transition to planned development.

A land use inspection will be set up under Article 43 of the bill, which will be an external body and responsible for verifying the level of application of the various provisions of the law.

The first schedule of the bill provides for fines of up to Rs 10 million and jail terms of up to three years for undertaking land-use planning works, except in accordance with the planning permission and regulations. applicable to development, failure of the implementation of an approved land use plan or building conversion within the stipulated time.

In addition, the Provincial Land Use and Construction Control Council will also be established. Headed by the Chief Minister, it will be responsible for approving policies and directives relating to the functioning of the authority. The board will meet twice a year.
